Terms of Use

pxCream is provided by OnSilent Pty Ltd (Australia) (“we”, “us”). By downloading or using the app you agree to the Standard EULA and these terms.

1. Credits

• Credits are a virtual item you can buy in the app and spend to unlock premium wallpapers.
• Credits have no cash value. They cannot be exchanged for money, transferred, or redeemed outside pxCream.
• Credits and unlocked wallpapers are tied to a random identifier stored securely on your iPhone, not to an account. They survive deleting and reinstalling the app on the same iPhone, but they do not transfer to another device. An active Unlimited subscription can be moved to a new device with Restore Purchases.
• All purchases are final. We cannot issue refunds. Refund requests are handled by Apple under its policies at reportaproblem.apple.com. If Apple refunds a purchase, we may remove the credits or access it granted.
• Wallpapers you unlock stay unlocked for re-download while the service is available.

2. pxCream Unlimited subscription

• Unlimited gives you access to all premium wallpapers while your subscription is active. pxCream Unlimited is a monthly auto-renewing subscription. The price is shown in the app before you confirm the purchase. There is no free trial.
• Payment is charged to your Apple ID account when you confirm the purchase.
• Your subscription renews automatically unless you turn off auto-renew at least 24 hours before the end of the current period.
• Your account is charged for renewal within 24 hours before the end of the current period, at the price of your selected plan.
• You can manage or cancel your subscription in your Apple ID account settings (Settings → your name → Subscriptions) or from Settings → Manage Subscription in the app. Deleting the app does not cancel a subscription.

3. Wallpaper licence

The wallpapers in pxCream are owned by us or our licensors. When you download a wallpaper (free or unlocked), we grant you a personal, non-exclusive, non-transferable, revocable licence to use it as a wallpaper on devices you own or control.

You may not:

• sell, sublicense, redistribute or share the wallpaper files, including in other wallpaper apps or sites;
• use them in commercial projects, merchandise, advertising, NFTs, or as part of a logo or trademark;
• use them to train or fine-tune machine-learning models;
• remove any notices or try to bypass the app’s premium protections.

Sharing a link or preview from the app’s Share button is fine.

4. The service

We may add, change or remove wallpapers and features. Some features need an internet connection. We work to keep pxCream available, but we do not guarantee it will always be available or error-free.

5. Prints

This section applies when you buy a physical print on pxcream.com. Apple’s Standard EULA does not apply to print orders.

• Prices. Prices are in Australian dollars and include GST and shipping to the countries listed on the prints page. Payment is taken by Stripe when you place the order.
• Made to order. Prints are printed for you in the United States by our printing partner and posted flat, unframed. Delivery times on the site are estimates, not guarantees.
• Duties and taxes. Orders delivered outside Australia may attract import duties or taxes in the destination country. These are not included in the price and are your responsibility.
• The image. Prints are a 1:2 shape, so each wallpaper is centred and cropped slightly to fit. Colours on paper differ from colours on a backlit screen, and small differences are not a defect.
• Misprints, damage and lost parcels. If a print arrives misprinted or damaged, or your parcel is lost, contact us through the support page within 15 business days of delivery (or of the latest delivery estimate, for a lost parcel) with your order reference and, for misprints or damage, a photo. We will reprint the affected prints or refund them.
• Change of mind. Because each print is made to order, we do not accept returns or give refunds if you change your mind.
• Brands and places. Some artworks show cars, places or other subjects you may recognise. Prints are our own artwork and are not made with, licensed by or endorsed by any company or brand that appears in them.
• Use. A print is for your own display or to give as a gift. The licence limits in section 3 still apply to the artwork itself: you may not copy it or sell reproductions of it.

6. Consumer rights

Nothing in these terms limits any rights you have under the Australian Consumer Law or other consumer protection laws that cannot be excluded. This includes your rights for prints that are faulty, not as described or not delivered.

7. Governing law

These terms are governed by the laws of Western Australia, Australia. The courts of that jurisdiction have non-exclusive jurisdiction.
